SERVICE (CADRE AND RECRUITMENT) RULES, 2018
PREAMBLE
Whereas, the draft of the Karnataka
Public Works Department Service (Cadre and Recruitment) Rules, 2018, which the
Government of Karnataka proposes to make in exercise of the powers conferred by
sub-section (1) of Section 3 read with Section 8 of the Karnataka State Civil
Services Act, 1978 (Karnataka Act 14 of 1990) was published in Notification No.
PWD 370 SPG 2014, dated 25/28-5-2018, in Part IV-A of the Karnataka Gazette,
dated 31-5-2018, inviting objections and suggestions from the persons likely to
be affected thereby within fifteen days from the date of its publication in the
Official Gazette.
Whereas, the said Gazette was made
available to the public on 31-5-2018.
And whereas, objections and
suggestions received in respect of the said draft have been considered by the
State Government.
Now, therefore, in the exercise of the
powers conferred by sub-section (1) of Section 3 read with Section 8 of the
Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the
Government of Karnataka hereby makes the following rules, namely.-
Rule - 1. Title and commencement.-
(1)
These rules may be called the Karnataka
Public Works Department Service (Cadre and Recruitment) Rules, 2018.
(2)
They shall come into force from the date of
their final publication in the Official Gazette.
Rule - 2. Method of recruitment and minimum qualification.-
The Karnataka Public Works Service
shall consist of the categories of posts with the scales of pay as specified in
column (2) of the Schedule below and the cadre strength, the method of
recruitment and the minimum qualifications, if any, shall be as specified in
the corresponding entries in columns (3), (4) and (5) thereof.
Rule - 3. Repeal and savings.-
(1)
The Karnataka Public Works Engineering
Department Service (Recruitment) Rules, 1988; (2) The Karnataka Public Works
Engineering Department Services (Recruitment of Assistant Executive Engineers
Division-I by Competitive Examination) Rules, 2007; (3) The Karnataka Public
Works Engineering Department Service (Recruitment) (Amendment) Rules, 2015; and
(4) The Karnataka Public Works Engineering Department Service (Recruitment)
(Amendment) Rules, 2018 published vide Notification No. PWD 172 SPG 2018, dated
23-8-2018, and any other Amendments to the Karnataka Public Works Engineering
Department Service (Recruitment) Rules, 1988, are hereby repealed:
Provided that the said repeal shall
not affect.-
(a)
the previous operation of the said rules or
anything duly done or any action taken under the said rule; or
(b)
any right, privilege, liability or obligation
already accrued or incurred under the said rules.

not available, an officer who has put in a service of not less than three

per cent by Direct Recruitment from amongst in-service candidates belonging
to Karnataka Public Works Engineering Service who possess the qualifications
prescribed for direct recruitment on the basis of the competitive examination
conducted by the Karnataka Public Service Commission in accordance with the
scheme specified in the Schedule II |
For Direct
Recruitment-(1) Must be a holder of Degree in Civil Engineering or
Construction Technology and Management or Building and Construction
Technology or Civil Engineering and Planning or Civil Technology or
Construction Technology or Construction Engineering and Management or
Geomechanics and Structures or Structural and Foundation Engineering or
Structural Engineering and Construction granted by a University established
by law in India recognised by AICTF, New Delhi or a Diploma Certificate
granted by the Institution of Engineers (India) that he has passed Parts A
and B of the Associate Membership Examination of the Institution of Engineers
(India) in Civil Engineering or Construction Technology and Management

4.
Provided that qualified Assistant Executive Engineer (Grade-II) may be
considered for transfer. (Fixation

(2)
Candidates who make application under in-service quota must have put in a
service of not less than five years in any of the cadres of Assistant
Engineer (Grade-I) or Assistant Engineer (Grade-II) or Junior Engineer in the
Public Works Department: |

|
|
Provided
that, notwithstanding anything contained In the Karnataka Civil Services (General
Recruitment) Rules, 1977, maximum age limit prescribed for direct recruitment
shall not apply to candidates who make application under in-service quota. |
|
|
|
|
|
|
For
Transfer-(I) Must be a holder of Degree in Civil Engineering or Construction
Technology and Management or Building and Construction Technology or Civil
Engineering and Planning or Civil Technology or Construction Technology or
Construction Engineering and Management or Geomechanics and Structures or
Structural and Foundation Engineering or Structural Engineering and
Construction granted by a University established by law in India recognised
by AICTE, New Delhi or a Diploma Certificate granted by the Institution of Engineers
(India) that he has passed Parts A and B of the Associate Membership
Examination of the Institution of Engineers (India) in Civil Engineering or
Construction Technology and Management Engineering may be transferred to the
cadre of Assistant Executive Engineer (Grade I). |

|
|
(2) Such
transfer shall be effective from the date of the commencement of these rules
or from the date of transfer to the cadre on acquisition of the prescribed
qualification, whichever is later. |

Note 1.- The
irrevocable option of the Assistant Executive Engineer (Grade-II) shall be
obtained before such transfer within the time stipulated by the Government. |

transfer shall be subject to the availability of vacancies without ignoring the
inter se seniority among these eligible for such transfer |

concerned Competent Authority shall provide an opportunity to Stenographers
to work as First Division Assistant for a period of not less than one year on
the basis of seniority, within a period of three years from the date of
recruitment/promotion to the cadre of Stenographer. |

SCHEME OF
EXAMINATION
1.
Title.-
This Scheme may be called the
Karnataka Public Works Engineering Service (Recruitment of Assistant Executive
Engineers Division-1 by Competitive Examination) Scheme.
2.
Definitions.-
(1)
In this Scheme, unless the context otherwise
requires.-
(a)
"Commission" means the Karnataka
Public Service Commission;
(b)
"Annexure" means the Annexure to
this Scheme,
(2)
Words and expressions used in this Scheme but
not defined herein shall have the same meaning as in the Karnataka Civil
Services (General Recruitment) Rules, 1977.
3.
Application.-
The provisions of this Scheme shall
apply to direct recruitment to the posts of Assistant Executive Engineers
Division-1 in the Karnataka Public Works Engineering Department.
4.
Method of recruitment.-
Recruitment to the posts of Assistant
Executive Engineer Division-1 under open competition quota (twenty per cent)
and in-service quota (five per cent) shall be made on the basis of the results
of competitive examination conducted by the Commission. The competitive
examination shall be held on such dates and at such places as may be notified
by the Commission from time to time.
5.
Age limits.-
Every candidate for appointment by
direct recruitment under this Scheme must have attained the age of twenty-one
years and not attained the age of.-
(a)
forty years in the case of a candidate
belonging to any of the Scheduled Castes or Scheduled Tribes or Category-I of
other Backward Classes;
(b)
thirty-eight years in the case of a candidate
belonging to any of the categories of other Backward Classes; and
(c)
thirty-five years in the case of any other
candidate, as on the last date fixed for receipt of applications or on
such other date as may be specified by the Government:
Provided that upper age limit
specified under (his rule shall not be applicable to candidates competing under
in-service quota.
6.
Academic Qualifications.-
No candidate shall be eligible for
recruitment unless he possesses a degree in Civil engineering or Construction
Technology and Management granted by a University established by law in India
or a Diploma Certificate from the Institution of Engineers (India) that he has
passed Parts A and B of the Associate Membership Examination of the Institution
of Engineers (India) in Civil Engineering or Construction Technology and
Management.
7.
Conduct of Competitive Examination.-
(1)
A competitive examination for recruitment to
the posts of Assistant Executive Engineers Division-1 for open competition
(twenty per cent quota) and for in-service competition (five per cent quota)
shall be held in the manner set out in the Annexure. The Commission shall call
for applications by advertisement for admission to the competitive examination
in such form as it may determine before such date and on payment of such fees
as may be specified by the Commission in the Advertisement. The Commission
shall also specify in such advertisement the provisional number of vacancies to
be filled and the number of vacancies reserved for Scheduled Castes, Scheduled
Tribes and other Backward Classes. The Commission shall be responsible for all
arrangements relating to the conduct of a competitive examination.
(2)
No person shall be admitted to a competitive
examination unless he holds a certificate of admission from the Commission. The
decision of the Commission as to the eligibility or otherwise of a person for
admission to the examination shall be final
8.
Scheme of Examination.-
(1)
The competitive examination shall consist of-
(a)
a written examination in Kannada, English,
General Knowledge and optional subjects specified in the Annexure; and
(b)
personality test.
(2)
The maximum marks for personality test shall
not exceed 5% of the marks fixed for competitive examination.
9.
Eligibility of Candidates for personality
test.-
The Commission shall prepare a
separate list of candidates under open competition and in-service competition
in the order of merit on the basis of the results of the competitive
examination. From among the candidates whose names are included in such list,
as far as may be, such number of candidates as is equal to five times the
number of vacancies notified shall be called for personality test subject to
calling candidates belonging to Scheduled Castes, Scheduled Tribes and Other
Backward Classes in the same ratio as the vacancies are reserved for them.
10.
List of selected candidates.-
(1)
The Commission shall prepare in the order of
merit a combined select list of candidates comprising of candidates selected
from open competition (twenty per cent quota) and from in-service competition
(five per cent quota) on the basis of the aggregate of the marks secured in the
written examination and personality test and after taking into consideration
the rules and orders in force relating to reservation of posts for Scheduled
Castes, Scheduled Tribes, Other Backward Classes and others.
(2)
The Commission shall, in accordance with the
provisions of sub-rule (1) also prepare an additional select list of candidates
in the order of merit who are not included in the final select list prepared
under sub-rule (1) The number of candidates included in the additional select
list shall be equal to 20 per cent of the number of vacancies notified in each
category under Rule 7 No person selected in the additional list shall be
appointed to a vacancy not notified for recruitment.
(3)
The lists so prepared under sub-rules (1) and
(2) shall be published by the Commission in the Official Gazette and a copy
thereof shall be sent to the Appointing Authority.
11.
Appointment of candidates.-
(1)
Candidates whose names are included in the
select list published under sub-rule (1) of Rule 10 may be appointed by the
Appointing Authority in the vacancies in the cadre in the order in which their
names are found in the list after satisfying itself, after such enquiry as may
be considered necessary, that each such candidate is suitable in all respects
for appointment as Assistant Executive Engineer Division-1.
(2)
The candidates whose names are included in
the additional select list published under sub-rule (2) of Rule 10 may also be
appointed by the Appointing Authority in the vacancies arising due to non-reporting
of candidates included in the final select list, in the particular category in
which the names are found in the additional select list, after such enquiry as
may be considered necessary,
(3)
The inclusion of names of candidates in the
final select list or additional select list prepared and published under Rule
10 shall not confer any right of appointment.
12.
Duration of the operation of the list-
The Select list and the additional
select list published by the Commission under Rule 10 shall be operative till all
the candidates in the select list are appointed to the number of posts notified
or for a period of one year, whichever is earlier.
13.
Application of General Recruitment Rules.-
Except in respect of matters for which
provision is made in this Scheme, the provisions of the Karnataka State Civil
Services (General Recruitment) Rules, 1977 for the time being in force, shall
be applicable for purposes of recruitment under this Scheme.
14.
Application of other rules.-
The Karnataka Civil Services Rules,
the Karnataka Civil Services (Conduct) Rules, 1966 and all other rules for the
time being in force regulating the conditions of service of Government servants
made or deemed to have been made under the Karnataka State Civil Services Act,
1978 (Karnataka Act 14 of 1990), insofar as such rules are not inconsistent
with the provisions of those rules, shall be applicable to persons appointed
under this Scheme.

The competitive examination shall consist of written examination and
personality test. Candidates shall answer all question papers, except Kannada
language paper, in English in their own hand,

Maximum marks- 100. Duration of the paper- 1 1/2 hours.

Kannada:
Maximum marks -100. Duration of the paper - 1 1/2 hours.
Note.-The marks obtained in compulsory papers i.e. in English and in
Kannada shall be of qualifying nature. For qualifying in these papers, a
minimum of 30% in each paper and 35% aggregate is prescribed. The marks
obtained in these two papers shall not be considered for determining the merit
for selection. Candidates who do not secure the prescribed marks in the
qualification papers, namely, Kannada and English, shall not be eligible for
personality test and selection.
(3)
General
Knowledge: Maximum marks-100. Duration of the Paper - 1 1/2 hours.
(4)
Optional
subjects: A candidate may select any two of the subjects specified in Part A
and any two of the subjects specified in Part B;
provided that a candidate who has selected the subject of Roads and
Bridges of Public Health Engineering in Part A shall not be eligible to select
the subject of Highway Engineering or Public Health Engineering, as the case
may be, in Part B.
Maximum marks for each subject -100. Duration of each of the papers -3

The Syllabi for papers on English and General Knowledge and of the

SYLLABUS
English (1): English paper will be of S.S.L.C level and comprises of
comprehension of given passage, precise writing, usage, vocabulary, short
essay, communication skills. For short essay a choice of subjects will be
given. Candidates are expected to keep close to the subject of the essay; to
arrange their ideas in orderly fashion and to write concisely- Passages will be
set for summary or precise. Credit will be given for effective and exact
expression.
Kannada (2): Kannada paper will be of S.S.L.C. level and comprises of
